My name is Givelle Lamano, and I’m a criminal defense attorney with Lamano Law Office. The goal of this video is to explain to you about what is called a wobbler. A wobbler is ultimately a crime that can be charged both as a misdemeanor or as a felony, and sometimes the crime can wobble up to a felony or wobble down to a misdemeanor. A great example of this is a DUI. If you have a basic DUI, it could be charged as a misdemeanor, but if there’s property damage or great bodily injury, that charge could wobble up to a felony.

Another example of a wobbler is also a domestic violence charge. If there was property damage, again, and/or injury, then the misdemeanor charges could rise up to a felony.
