Public intoxication, drunk in public, drunk and disorderly conduct - all refer to the same crime that's treated differently in different states.

What happens if you have been arrested for being drunk in public, also known as, Penal Code 647(f), Public Intoxication?

>> Givelle Lamano:
In order for you to be charged with this type of a crime, or found guilty of this crime, there have to be a few things that are met. Number one, you are actually in a public space. Number two, you were willfully intoxicated. And number three, you were so intoxicated that you couldn't exercise care for yourself or others, or you were disturbing a public property area.

>> Givelle Lamano:
Now, a couple of the defenses to this is that, number one, you either weren't willfully intoxicated or there was insufficient evidence to show how intoxicated you were. Number two, you actually weren't in a public space. Or, number three, that you were actually able to exercise due care for yourself.
